5. Uso aceptable

US$100 si no has pagado nada).

12. Arbitraje individual y renuncia a acciones colectivas

Terms of Service

Effective October 13, 2026

By using this site, or by requesting or using our services, you accept these terms, the Privacy Policy and the SMS/WhatsApp Terms & Recording Notice. If you do not agree, do not use the site.

The Spanish version is provided for your convenience. If there is any difference between the versions, the English version controls, unless applicable law requires otherwise.

1. Who we are and your contract

Marketing Plan Easy is an independent agency located at 30141 Antelope Road, D #680, Menifee, CA 92584. Services you purchase are also governed by the proposal or contract you sign or accept. If there is a conflict, your contract controls on price, scope, term, renewal and cancellation; these terms control on everything else.

2. Services and no guarantee of results

We offer websites, CRM, virtual assistance and social media management, among others. Price, scope, timelines, automatic renewal and cancellation are set out in each proposal or contract. We do not guarantee results (leads, sales, revenue, Google rankings, social reach), because they depend on factors outside our control: market, budget, competition, your offer and your service. Any example, figure or testimonial is illustrative and does not promise a result.

3. Third-party platforms

Our services depend on third-party platforms (HighLevel, Meta/WhatsApp/Instagram/Facebook, Google, SMS, telephony and payment providers). Those platforms have their own terms, may change features, prices or policies, and may suspend accounts in ways we cannot prevent. We are not responsible for those changes or for third-party outages. Usage such as messages, calls and ads may be billed separately. We are an independent agency, not affiliated with or endorsed by Meta, Google or WhatsApp.

4. Your responsibilities as a client

If you use our tools to contact your own clients or prospects, you are responsible for: (a) complying with messaging and calling laws (TCPA, CAN-SPAM, carrier and WhatsApp rules); (b) obtaining and keeping the consents required to send messages; (c) giving notice and obtaining consent to record calls and video calls; (d) the accuracy of what we publish for you; (e) having licenses, permits and rights to the photos, logos and content you give us; and (f) complying with the laws of your trade and advertising. Our tools and templates are not legal advice.

5. Acceptable use

You may not use the site or our services for unlawful activity, to send spam or unsolicited messages, to infringe others' rights, to introduce malware, to scrape data in an automated way, to interfere with security, or to attempt unauthorized access. We may suspend access if you breach these terms.

6. Intellectual property

Site content (text, design, logos, images, code) belongs to us or our licensors and is protected by law. You may not copy or use it without written permission. Third-party trademarks belong to their owners. What you give us remains yours; you grant us a limited license to use it to provide you the service. If you send us feedback or ideas, we may use them freely. Unless your contract says otherwise, we do not transfer ownership of our templates, processes or tools to you.

7. Affiliate and third-party links

Some links on this site may generate commissions or income for us, through affiliate programs or arrangements with third parties, usually at no extra cost to you. Our affiliation with HighLevel is one example. See the Affiliate Disclosure. We do not control third-party sites and are not responsible for their content, products or privacy practices.

8. Communications

By giving us your information you agree we may contact you by phone, email, SMS and WhatsApp per the SMS/WhatsApp Terms & Recording Notice, and that our calls and video calls are recorded. You may opt out at any time. You agree to receive legal and service notices electronically.

9. No warranties

To the extent the law allows, the site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free. Content is informational and is not legal, tax, financial or professional advice.

10. Limitation of liability

To the extent the law allows: (a) we are not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue, customers, data or reputation; and (b) our total liability for any claim relating to the site or services will not exceed what you paid us in the 3 months before the event giving rise to the claim (or US$100 if you paid nothing). Nothing in these terms limits liability that cannot be limited by law (for example for fraud or willful misconduct). Some laws do not allow certain limitations, so they may not apply to you.

11. Indemnification

You agree to defend and indemnify us against claims, damages and expenses (including reasonable attorneys' fees) arising from: your breach of these terms or the law; content you give us; messages, calls and recordings you make with our tools without the necessary consents; or violation of third-party rights.

12. Individual arbitration and class-action waiver

Please read this section carefully: it affects your rights. Except as stated below, any dispute between you and us will be resolved by binding individual arbitration before the American Arbitration Association (AAA) under its applicable rules, administered in Riverside County, California, or by video if both parties agree. You waive the right to participate in class, group or representative actions and to a jury trial. Excluded are: (i) claims in small claims court; (ii) injunctive relief to protect intellectual property or confidentiality; and (iii) any matter the law does not allow to be arbitrated. The Federal Arbitration Act governs this section. You may opt out of arbitration by emailing contacto@marketingplaneasy.com within 30 days after first accepting these terms, stating your name and that you opt out. If any part of this section is unenforceable it is severed and the rest continues, except that if the class-action waiver is unenforceable, the class claim will be decided in court.

13. Governing law and courts

These terms are governed by the laws of the State of California and U.S. federal law, without regard to conflict-of-law rules. For anything not arbitrated, the parties submit to the state and federal courts of Riverside County, California.

14. General

These terms, together with your contract and the linked policies, are the entire agreement. If a provision is unenforceable, the rest remains in effect. Our failure to exercise a right is not a waiver. You may not assign these terms without our permission; we may assign them in a sale or reorganization. We are not liable for delays caused by events beyond our reasonable control. Sections that by their nature should survive, survive. We may modify these terms by posting the new version with its date; continued use of the site or services means you accept it. Notice to California residents (Civil Code §1789.3): for complaints you may contact the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, (800) 952-5210.
